Alternative Dispute Resolution
1.1 These General Terms and Conditions (“GTC”) apply to all contracts between Coutie UK Ltd. (hereinafter “Seller”) and any consumer or business customer (hereinafter “Client”) for goods and/or services listed in the Seller’s online store.
1.2 These GTC also apply to the sale of gift vouchers, unless expressly stated otherwise.
1.3 A “Consumer” means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
1.4 A “Trader” means a person or legal entity acting in the course of a business, trade or profession.
2.1 Product listings on the Seller’s website are invitations to treat and not binding offers.
2.2 The Client makes a binding offer by submitting an order via the online checkout process.
2.3 The Seller may accept the offer by:
Sending an email confirmation;
Dispatching the goods;
Requesting payment.
The contract is formed upon the first of these events.
2.4 Where the Client uses PayPal, Amazon Pay, Klarna or other digital payment gateways, the contract is concluded upon successful payment authorization.
2.5 Contract information will be sent to the Client via email after the order is placed. Past orders can also be accessed by registered users through their account.
2.6 Contracts are available in English only.
2.7 The Client is responsible for ensuring the accuracy of their email address and for checking spam folders for confirmation emails.
3.1 Consumers have the legal right to cancel their order within 14 days without giving any reason.
3.2 Full details of the cancellation policy are provided in the Seller’s Cancellation Policy.
4.1 All prices are in GBP and include VAT where applicable.
4.2 Delivery charges are shown separately at checkout.
4.3 Payment methods may include debit/credit cards, PayPal, Amazon Pay, Klarna, Shopify Payments or other options displayed on the website.
4.4 Some payment methods may be subject to credit checks.
4.5 If the chosen payment method is declined, the Seller reserves the right to cancel the order.
5.1 The Seller delivers to the UK and other locations as specified during checkout.
5.2 Delivery is to the address provided at checkout. If paying via PayPal, the address registered with PayPal will be used.
5.3 If goods cannot be delivered and are returned to the Seller, re-delivery costs may apply unless the Client has exercised their cancellation right.
5.4 Collection in person is not available.
5.5 Digital products such as gift vouchers are delivered via email.
Ownership of goods remains with the Seller until full payment is received.
7.1 Consumers have legal rights under the Consumer Rights Act 2015.
7.2 Faulty or misdescribed items can be returned within 30 days for a refund or replacement.
7.3 The Seller may request evidence of the defect before issuing a replacement or refund.
7.4 Business Clients must inspect goods upon receipt and notify the Seller of any defects within 5 working days.
8.1 The Seller accepts unlimited liability for:
Death or personal injury caused by negligence;
Fraud or fraudulent misrepresentation;
Breach of legal obligations under UK consumer protection laws.
8.2 For all other loss or damage:
The Seller is only liable for foreseeable losses resulting from a breach of contract;
No liability is accepted for business losses, indirect or consequential damages.
9.1 Gift vouchers can only be redeemed on the Seller’s website.
9.2 Vouchers are valid for three (3) years from the date of purchase.
9.3 Vouchers must be applied before completing checkout.
9.4 Only one voucher may be used per order.
9.5 Vouchers are non-refundable and non-exchangeable for cash.
9.6 If the order value exceeds the voucher amount, the balance must be paid using another method.
9.7 Vouchers are transferable unless otherwise stated.
